Tontorra is committed to protecting your privacy and strives to process your Personal Data in a transparent and confidential manner in compliance with the applicable regulations. This Privacy Policy concerns Personal Data of natural persons, in particular data that allow for the direct or indirect identification of a person.

It describes Tontorra's practices with respect to the information it collects from users who access its website at www.remcoev.com (‘Site’), or who otherwise share personal information with it (collectively: the ‘Users’). This Privacy Policy only applies to Tontorra services. By using our Site, you indicate that you accept its terms.

  • Surname;
  • Address details (for invoicing and delivery);
  • Bank details for processing the order and payment;
  • Email address;
  • Telephone number;

  • Device Information: We collect Personal Data from your device. This data may include location data, IP addresses, unique identifiers (e.g. MAC address and UUID) and other information related to your activities on the site.

The second type of information is unidentified and non-identifiable information related to one or more User(s), which may be made available or collected as a result of your use of the Site (‘Non-Personal Data’). We are not aware of the identity of any User from whom Non-Personal Data has been collected. The Non-Personal Data collected may include aggregate data about your usage and technical data transmitted by your device, including certain software and hardware data (e.g. about the browser and operating system your device uses, your language preference, access time, etc) in order to improve the functionality of our Site and ensure its optimal functioning. Tontorra will collect and process the above data to the extent and where relevant for the purposes referred to in this Privacy Policy. We will not disclose your Personal Data to third parties, unless necessary for the execution of the contract you have concluded with us or if required by law. In the event of suspected fraud or abuse of the Site, we may hand over Personal Data to the competent authorities.

How does Tontorra use your Personal Data and how long do we retain it?

Your Personal Data will be used for the following purposes:

  • To create an Online Account;
  • To execute a Sales Contract;
  • Order Handling: to process orders and report the status of orders to you, the customer;
  • To finalise payment;
  • To provide you with proper customer service;
  • To ensure the best possible operation of our website/shop;
  • For marketing purposes;
  • To handle a question or complaint.
  • After anonymisation of the data, to compile statistics or conduct surveys on the number of visits to the various sections of the Site.
  • For statistical and analysis purposes to improve the site.
  • To protect our legitimate interests and to respect our financial and legal obligations.

Disclosure to third parties

We may disclose the data that you provide us to third parties if this is necessary for the fulfilment of the purposes described above.

Data you fill in while placing an order or sending a message will be stored on our Shopify processor's servers. Shopify hosts and manages our Site. It implements appropriate organisational and technical measures to protect Personal Data.

A link to SendCloud is used to process and ship our orders. SendCloud receives your address data (delivery address) from us in order to send/deliver the orders. Delivery in Belgium is performed by Bpost and/or DPD and/or PostNL.

Your online payments are processed by our partner Shopify.

Our link to the meta-platform makes it possible to link our products on social media to the Shopify product catalogue. User access to this link is restricted by a privacy setting but can be re-activated by changing the setting on the privacy banner.

We may also disclose information when we believe, in good faith, that it is useful or reasonably necessary to share such information in order to: (i) comply with applicable laws, regulations, legal processes or governmental requests; (ii) enforce our policies (including our Contract) and investigate possible violations thereof; (iii) investigate, detect, prevent or address illegal activities or other violations, suspected fraud or security concerns; (iv) establish and exercise our rights to defend against legal claims; (v) prevent harm to our rights, property or safety as well as to the rights, property or safety of our users, you or any third party; or (vi) cooperate with law enforcement authorities and/or where we deem it necessary to exercise intellectual property or other rights.

Marketing

We may use your Personal Data, such as your name, email address, telephone number, etc, ourselves or with the help of our third-party subcontractors to provide you with promotional materials relating to our services in which we believe you would be interested. 

Out of respect for your right to privacy, these advertising materials will also offer you the opportunity to opt out of receiving future promotional materials from us. If you unsubscribe, we will remove your email address or phone number from our marketing list. 

Please note that even if you have unsubscribed from our marketing emails, we may still send you other important email messages for which we do not offer you the opportunity to unsubscribe. They may include customer service messages or administrative communications.

Third-party data collection

Our policy deals exclusively with the use and disclosure of information that we collect from you. If you disclose your data to other parties or on other internet sites, other rules may apply to their use or disclosure of the information that you provide them. How long does Tontorra retain your data?

Tontorra will retain your Personal Data for as long as necessary to provide our services and to comply with our legal obligations and settle disputes.

Tontorra will use your Personal Data for specified purposes and will only collect the Personal Data necessary to achieve those purposes. We want to be as transparent and clear as possible about the activities for which we collect and use your Personal Data.

  • Right to be informed: you have the right to be informed in a clear and transparent manner about the Personal Data that Tontorra processes from you and for what purpose this processing takes place.
  • Right of access: it is your right to know the Personal Data that Tontorra holds about you.  Before granting access to the data, Tontorra may ask you for proof of identification.
  • Right to rectification: you have the right to require Tontorra to correct or complete any incorrect or incomplete Personal Data that it holds about you. You are responsible for the accuracy of the data when you provide it to Tontorra.

You can update your account information in your online personal account at any time.

  • Right to erasure: you can request the deletion of your Personal Data free of charge, in the following cases:
    • The Personal Data is no longer necessary for the purposes for which it was collected and/or processed;
    • You revoke your consent and there is no other legal basis for processing the Personal data;
    • The Personal Data has been processed unlawfully;
    • The Personal Data must be deleted in order to comply with a legal obligation incumbent on Tontorra;
    • You object to the processing and there are no overriding compelling legitimate grounds, or;
    • In case of direct marketing, you have the right to erase your Personal Data at any time
    • The consequence of such a removal may well be that certain services of Tontorra can no longer be provided.
  • Right to restrict processing: you have the right to request that the processing of your personal data be restricted. This means that we may retain the data, but not process it further.
  • Right to withdraw consent: you may, at any time, withdraw your consent to the processing of Personal Data collected by Tontorra that you may have previously granted. For example, you can opt out of the newsletters and our marketing communications. Please note that a certain processing time is needed to process your request and that, in the meantime, you may still receive communications. Please also note that withdrawing your consent does not affect any processing carried out by Tontorra before your consent was withdrawn.
  • Right to object: you can exercise your right to object to the processing of your Personal Data for compelling and legitimate reasons by sending an email to webshop@remcoev.com.You can object at all times against the processing of your Personal Data for direct marketing purposes. However, you cannot object to the processing of your Personal Data if it is necessary for the performance of the contractual obligations.
